An intention to create legal relations is a core part of the creation of a contract.
For example:
If you give me a ride to work I'll mow your lawn
This comes off as more of a social contract rather than something that has an intention to create legal relations. I doubt I'll be sued if I don't mow their lawn after they give me a ride.
Generally it's up to the claimant to prove this intention.
